Marriage not registered Legal seperation Qn. I was separated from my ex-spouse for past years. After she walked out of the marriage leaving me and my years child i moved to . I applied for divorce in India years back which is still pending as my ex-spouse is not responding to any summons. I became citizen of a year back and 2 months back i applied for divorce here and last week divorce got finalized. I haven't been to India for past years plus, couldn't go as she was threatening to take my child away. For the welfare of my child i decided not to go to India, my child is also citizen of now. I need some advice on if i were to go and visit my parents in India what am i supposed to do so as to keep my child safe and return to after holiday without any issues? I feel like if she comes to know that i am in India she can file any false care to stop us from flying back and then try to take my child away as Indian court mostly favours women when it comes to parenting orders.
