As judgement was not pronounced on ** due to pandemic outbreak, hearing in court was suspended till ****. This case was again posted for argument due to change in presiding officer on ****. From ***, the date when the matter was posted for judgement to actual date of judgement ***, there is time interval of ** months, out of which ** months the court was not functioning due to covid outbreak and further from **** to ****, decree holder dragged the case intentionally by not providing her asset and liabilities accurately. This is the status and kindly advise.

Marriage not registered Legal seperation

I was separated from my ex-spouse for past ** years. After she walked out of the marriage leaving me and my ** years child i moved to **. I applied for divorce in India ** years back which is still pending as my ex-spouse is not responding to any summons. I became citizen of ** a year back and 2 months back i applied for divorce here and last week divorce got finalized. I haven't been to India for past ** years plus, couldn't go as she was threatening to take my child away. For the welfare of my child i decided not to go to India, my child is also citizen of ** now. I need some advice on if i were to go and visit my parents in India what am i supposed to do so as to keep my child safe and return to ** after holiday without any issues? I feel like if she comes to know that i am in India she can file any false care to stop us from flying back and then try to take my child away as Indian court mostly favours women when it comes to parenting orders. My child is schooling in ** since ****, i have been her 100% carer since ****. Do i need to take any precautionary steps before i decide to travel to India with my child?
